55+ Community Rules and Age Requirements in Arizona
Every 55+ community operates under the same federal framework but layers its own rules on top, and the gap between the two trips up a lot of buyers. Here’s what’s actually true.
Age Requirements: Federal Law vs. Community Bylaws
Federally, the Housing for Older Persons Act only requires one resident per household to be 55 or older, the other spouse can be younger. But individual communities set their own minimum age for that younger spouse in their bylaws, commonly 40 or 45, so the real rule depends on the specific community, not just federal law. I check this for every client before they fall in love with a specific house.
Guest Policies
Short visits from kids and grandkids are standard and expected almost everywhere, but most communities cap total guest days per year, often somewhere in the 30 to 60 day range, rather than banning extended visits outright. If having family stay for longer stretches matters to you, I pull the specific policy for any community you’re considering.
Rental Rules
Rental rules are where communities differ the most. Some allow long-term rentals with restrictions, others limit it heavily or require a minimum lease term, and this matters even if you’re not planning to rent right now, it affects resale flexibility down the road.
